Legislative Practice in the Western Fujian Soviet Area

闽西是全国最早建立红色政权的地区之一。在夺取政权后,如何有效地巩固政权和深化革命,是特殊历史条件下对闽西苏区政府行为和职责的一种考验。经过苏维埃政府成立的筹备和工农兵代表大会代表的确立,闽西苏区通过工农兵代表大会制定法律来重新确定秩序。以闽西工农兵代表大会立法为代表的立法实践,形成了相对完备、系统的法律制度,创造了中华苏维埃共和国成立之前立法的高峰——开展立法时间早,颁布法律多,立法符合实际首创性强,且立法在闽西广泛实践,开辟了中国法制现代化的新道路,摒弃了旧有的法制,开创了人民民主法制。

Western Fujian Soviet Area was one of the earliest regions in China establishing a red regime.After seizing power,how to effectively consolidate the power and deepen the revolution was a test of the governmentbehavior and responsibilities in the Western Fujian Soviet Area under the special historical conditions.After the preparations for the establishment of the government in the Western Fujian Soviet Area and the establishment of representatives of the workers,peasants and soldiers congress.Western Fujian Soviet Area had adopted laws to reestablish order.The legislative practice represented by the legislation of the congress of workers,peasants and soldiers in Western Fujian Soviet Area had formed a relatively complete and systematic legal system and created the peak of legislative before the establishment of the Chinese Soviet Republic.The legislative practice was carried out early,many laws were promulgated in this legislative practice and the legislation were in line with actual,had strong initiative and widely practiced in Western Fujian Soviet Area.The legislative practice created a new path for the modernization of Chinas legal system,which had abandoned the old legal system and created the peoples democratic legal system.
