论出售型重整的重要性及其完善

On the Importance and Perfection of Sale Type Reorganization

出售型重整作为近年来一个较为新兴的破产重整模式,在实践中已有不少成功运用该模式进行破产重整的案例,相比于传统的存续型重整,其所具有的比较优势能够促使企业更快、更高效的完成重整。本文试图通过对该类型案例的引入,探讨出售型重整存在的必要性,在运用过程中凸显的优越性,为该制度的存续寻求理论支撑,同时对该制度存在的问题提出一定的完善建议。

As a relatively new bankruptcy reorganization mode in recent years,although there is no clear legal provi‐sions in the enterprise bankruptcy law,there have been many successful cases of bankruptcy reorganization using this mode in practice.Compared with the traditional survival reorganization,its comparative advantages can promote enterpris‐es to complete reorganization faster and more efficiently.Through the introduction of this type of cases,this paper at‐tempts to explore the necessity of the existence of the sale type reorganization,the advantages highlighted in the process of application,to seek theoretical support for the existence of the system,and put forward some suggestions to improve the existing problems of the system.
