摘要
地理标志的运用是促进乡村发展的有效工具。通过比较意大利与我国的地理标志制度,并从制度框架、运行体系和运行情况三个方面进行分析,发现意大利保护地理标志的专门立法模式以"自下而上"的方式运行,而我国的混合模式更倾向于"自上而下"的方式。尽管我国地理标志注册数量近年来增长较快,但其潜在价值并没有得到有效发挥。为充分激发地理标志的作用,需进一步拓宽地理标志产品的推广形式,加强部门合作,加强地理标志领域的监督执法。
The use of Geographical Indication(GI)is an effective tool in promoting rural development.This paper compares the GI regime between China and Italy,and analyzes their institutional framework,operation system and operating situation.It is found that the GI protection in Italy applies a special legislation mode is running in an"bottom up"way,while China applies a mixed GI protection mode running in an"top down"way.Although a large number of GIs are registered in China in recent years,their potential value has not been fully played.In order to promote the effects of GIs,governments need to enhance cooperation and improve active supervision and enforcement in geographical indications.
