现阶段EPC总承包工程合同价款的研究

Research on the Contract Price of EPC General Contract Project at Present Stage

EPC(Engineering Procurement Construction)总承包是指按照总承包合同对建设项目的设计、采购、施工等实行一体化总承包。总承包单位对其所承包项目的进度、费用、质量、安全等进行全面的管理和控制,最终提供给委托方合格的建筑产品。当前EPC总承包工程项目合同价款一般为固定总价与"总价合同"框架下的其他形式可调价总价,因招投标阶段设计设定不明确、施工标准设定模糊、施工范围界定不清、施工过程及设计变更等,后期的结算价款调整争议很大。文章通过探讨EPC总承包各种合同价款类型及其利弊,分析EPC总承包项目建设造价管理过程中不同合同价款类型产生的难点和争议等热点问题,并试着研究问题解决的办法。

EPC refers to an integrated general contract for the design,procurement and construction of a construction project in accordance with the general contract.The general contractor shall comprehensively manage and control the schedule,cost,quality and safety of the contracted projects,and finally provide qualified construction products to the client.At present,EPC general contract project contract price is generally fixed total price and other forms of adjustable total price under the framework of"total price contract".Due to the unclear design setting,fuzzy construction standard setting,unclear construction scope,construction process and design changes in the bidding stage,the settlement price adjustment in the later period is highly controversial.Through this paper,the author discusses various contract price types of EPC general contract and their advantages and disadvantages,analyzes the difficulties and disputes arising from different contract price types in the construction cost management process of EPC general contract project,and tries to study the solutions to the problems.
