国家市场监督管理总局承担综合性监管职责,总局内设司局负责行业性监管,应当建构以市场失灵为监管理论基础的分析框架,应对不完全竞争、信息不对称、负外部性与公共物品不足的四种问题。监管是行政主体根据法律、行政法规和国务院决定,对市场主体与客体实施的直接干预行为,目的是解决市场失灵问题,维护市场竞争秩序,保障人的生命、经济、社会、环境与国家安全。统筹事前监管、事中监管与事后监管的方法与工具,在市场与监管动态发展和不断调整的背景下,为新形势下市场监管提供新的理论基础、内在逻辑与整体思路。

State Administration for Market Regulation assumes the responsibilities of the comprehensive regulation and departments and bureaus of it are responsible for industry supervision.It is necessary to construct an analytical framework based on market failure as the theoretical basis for supervision to deal with four problems of imperfect competition,asymmetric information,negative externalities and insuffi cient public goods.Market regulation should refer to the direct intervention of administrative agencies on market subjects in accordance with laws,administrative regulations and decisions of the State Council,with the aim of solving the market failure,maintaining the market competition order and safeguarding the interests of the life,economy,society,environment and national security.Under the backgrand of the dynamic development and continuous adjustment of the market and supervision.this article coordinates the methods and tools of ex ante,on-going and ex post regulation,and provides a new theoretical basis,internal logics and general thoughts for market regulation under the new situation.
