村规民约作为一种历史性存在,在中国历史中起到了稳定乡土社会秩序的作用。当今村规民约作为基层自治的组成部分,发挥着稳定秩序、凝聚共识和推动基层治理的功能。乡村振兴战略的实施将村规民约纳入了顶层设计之中,将其作为塑造乡风文明、创新基层治理的重要资源。构建运转有效的村规民约的前提是明确村规民约的结构要素和运作机理。话语制度主义强调制度的观念属性,为构建理解村规民约的制度分析框架提供了基础。在这一分析框架中,村规民约可以被解码为认知性、规范性、建构性三种观念要素,具有观念认同和规范约束两大功能,并通过话语模式在社会背景和村庄生活中动态呈现。乡村振兴的进一步推进需要村规民约增强其观念代表性,夯实规范约束的内在认同基础。

As the historical existence,Village regulations play a role in stabilizing the local social order in Chinese history.Nowadays,as a part of grass-roots autonomy,Village regulations play the role of stabilizing order,uniting consensus and promoting grass-roots governance.The implementation of strategy for rural revitalization has included village regulations in the top-level design,ase an important resource for shaping rural customs,promoting civilization and innovating grass-roots governance.The premise of constructing effective village regulations is to make clear its structure elements and operation mechanism.Discursive institutionalism emphasizes the conceptual attribute of the system,which provides the foundation for the construction of the institutional analysis framework to understand the village regulations.In this analytical framework,village regulations which can be deciphered into three conceptual elements,including cognitive,normative and constructive parts,has two functions of idea identity and normative constraints,and is presented dynamically in the social background and village life through the discourse pattern.To further promote rural revitalization,it is necessary to enhance the representativeness of village regulations and consolidate the internal identity foundation of normative constraints.
