智慧司法:刑事裁判文书改革的局限与前瞻

智慧司法的初衷是助推以审判为中心的诉讼制度改革,提升司法质效、促进司法公正、预防冤错案件。然其在运行逻辑和外部机制方面都存在明显缺陷。当下中国的刑事司法环境结构化程度不高且较为复杂,既对司法人工智能技术的中立性形成冲击,又束缚了审判人员的职业化思维,对刑事裁判文书的改革亦形成潜在的窒碍。应当直面改革的难点与痛点,以系统化的思维整体设计和构思刑事裁判文书改革路径,强化司法系统的文化建设,加速决策者与司法者的思维调整与理念更新;以"内容"为中心改革裁判文书的撰写与制作,其余细枝末节交由司法人工智能辅助完成;同时还应明确司法人工智能的技术伦理与应用边界。

The original intention of smart justice is to promote the reform of the trial-centered litigation system,improve the quality of justice,promote judicial justice,and prevent wrongful cases.However,it has obvious flaws in its operational logic and external mechanisms.The current criminal justice environment in China is not highly structured and relatively complex,which not only impacts the neutrality of judicial artificial intelligence technology,but also restricts the professional thinking of judges,and also poses a potential suffocating obstacle to the reform of criminal judgment documents.We should face up to the difficulties and pain points of reform,design and conceive the reform path of criminal judgment documents with systematic thinking,strengthen the cultural construction of the judicial system,and accelerate the thinking adjustment and concept update of decision-makers and judicial makers;reform with“content”as the center The writing and production of judgment documents,and the remaining details are assisted by judicial artificial intelligence;at the same time,the technical ethics and application boundaries of judicial artificial intelligence should be clarified.
