数据是否应适用必需设施原则?--基于“两种错误”的分析

Should the Data Apply the Essential Facilities Doctrine?--Analysis Based on"Two Types of Errors"

本文在对数据资源的特点、必要设施原则的发展史进行归纳的基础上,采用“两种错误”的观点对数据是否可以适用必需设施原则进行了讨论。本文认为,应该根据具体情况决定是否适用该原则。为了防止适用必需设施原则后“第一类错误”的大幅度增加,可以引入严格的适用条件,控制其发生的概率。在此基础上,再适用必需设施原则,降低“第二类错误”。参考现有文献中对于必需设施原则适用标准的讨论,本文提出了对数据适用必需设施原则的五个准则。

On the basis of summarizing the characteristics of data resources and the development history of the essential facilities doctrine,this paper discusses whether the doctrine should be applied to data resources from the viewpoint of "two types of errors".This paper holds that the application of this doctrine should be decided according to the specific situation.In order to prevent the increase of "type Ⅰ error" after applying the principle of necessary facilities,strict application conditions can be introduced to control the probability of its occurrence.On this basis,the doctrine should be applied to reduce "type Ⅱ errors".Referring to the discussion of the standards for the application of the essential facilities principle in the existing literature,this paper puts forward five criteria for the application of the essential facilities principle to data.
