什么是法理?或法理是什么?这是法理学的首要问题,也是法学共同关注的问题。法理可以是法的原理、公理、条理、原则、美德、价值等等,但与它们相比,还有更基础的前提、更原本的意义和更内核的内容,那就是法的感觉(悟)、意识、观念、理念、思想、理论和诗情。法理要具备感觉、意识、观念、理念、思想、理论和诗情的属性和内容,法理是法化的感觉、意识、观念、理念、思想、理论和诗情。法理只有努力成为感觉、意识、观念、理念、思想、理论和诗情,才是基础前提、原本意义和内核东西上的法理,也才能真正发挥法理的作用。由感觉到意识、由意识到观念、由观念到理念、由理念到思想、由思想到理论、由法理兼诗情直至情理融合,这不仅是法理的几种具体表现形式,而且是法理的一般发展规律。
