积极刑法观视野下微罪扩张的后果及应对

On the Consequences of and Countermeasures to the Expansion of Petty Offenses in the View of the Concept of Positive Criminal Law

近年来,在积极刑法观背景下我国的微罪概念正在形成,微罪的扩张呈现出不可逆转之势。微罪的发展在取得积极社会治理功效的同时,引发了不容忽视的负面后果泛化问题,特别是围绕醉酒型危险驾驶罪所造成的越来越严重的犯罪标签泛化问题。为此,应着力消除积极刑法观下微罪扩张的附随性负面后果,拓展审判阶段的出罪、审查起诉阶段的不起诉、立案侦查阶段的不立案或撤销案件在去微罪附随性负面后果泛化上的积极功效,同时,建立与微罪惩处相配套的前科消灭制度,根本性地消除微罪附随性负面后果。若前科消灭制度不能一步到位地建立,可以在司法实践探索的基础上分步骤地实现。

Recently,under the background of the concept of positive criminal law,the concept of petty offenses has been coming into existence and the expansion of petty offenses has shown its irrevocable trend.The development of petty offenses,while achieving positive effect of social governance,brings about the problem of extended negative consequences that cannot be ignored,especially the increasingly serious problem of extended criminal labels caused by the crime of driving under the influence of alcohol.Thus,efforts should be made to eliminate negative consequences attached to the expansion of petty offenses under the concept of positive criminal law,and expand the active effects of non-conviction in the trial stage,non-prosecution in the examination and prosecution stage,non-filing or revocation of cases in the filing and investigation stage on eliminating the extended negative consequences attached to petty offenses.Meanwhile,the system of eliminating criminal record compatible with the punishment for petty offenses should be established to fundamentally eliminate negative consequences attached to petty offenses.If such system of eliminating criminal record cannot be established in one step,it may be realized in a step-by-step way on basis of judicial practice and exploration.
