智慧司法进入了全面应用的阶段,也产生了新的实践问题。智慧司法之法理反思直面实践问题背后的本质,从本体论视角批判性分析法律代码化、审判模式重塑和审判权嬗变等困境。从方法论视角反思“同案同判”、道德推理和价值判断、法律预测等法律方法的功能替代效应。从技术视角反思智慧司法自身面临的大数据挖掘难题、算法偏见和其他技术瓶颈。法理反思不是为限制智慧司法,而是探究问题背后的深层次原因,启发找到解决问题的思路和方案。法理反思的价值在于引导智慧司法理解法理,遵循司法规律,满足司法实践的需求,使之与法律人的思维和方法相适应,推动人工智能等新科技与法律的深度融合。

Smart Justice has seen an era of comprehensive application,and new practical problems occur.The juridical reflection on Smart Justice is directly targeted at the essence behind practical problems,so as to constitute a critical analysis of predicaments such as codification of laws,transformation of trial mode and the evolution of judicial power from the perspective of ontology.From the perspective of methodology,we reflect on the functional substitution effect of legal methods such as"treating like cases alike",moral reasoning,value judgment,and legal prediction.From the perspective of technology,we reflect on the big data mining difficulty,algorithm biases and other technical bottlenecks faced by Smart Justice itself.Juridical reflection is not to limit Smart Justice,but to explore the in-depth causes behind the problems and to inspire ideas and plans for resolving such problems.The value of juridical reflection is to guide Smart Justice to understand jurisprudence follow the law of justice and meet the needs of judicial practice,thus making it be compatible with the thinking and methods of legal professionals,and promoting the deep integration of new technologies(such as AI)and the law.
