Legal Analysis and International Cooperation of Port Epidemic Prevention

新冠肺炎疫情在全球多点爆发并快速蔓延,给全球公共卫生安全带来了巨大挑战,各国纷纷采取了一定的港口限制措施。本文认为,海上运输自由与公共卫生保护具有不同的价值追求,但二者之间需要平衡。无疫入港许可和非歧视原则可为平衡二者关系提供国际法依据,而各国港口加强防疫国际合作是保障海上运输和国际贸易正常运行的有效路径。

The outbreak of novel coronavirus pneumonia has spread worldwide and has spread rapidly,which poses great challenges to global public health security.This paper holds that freedom of maritime transportation and public health protection have different value pursuits,but they need to be balanced. The principle of non discrimination and the permission to enter the port without epidemic diseases can provide the basis of international law for balancing the relationship between them.
