海南自贸港法规的规范属性、基本功能与制度发展--以《宪法》和《立法法》为分析视角

The Normative Attribute,Basic Function and Institutional Development of Hainan Free Trade Port Regulations-From the Perspective of Constitution Law and Legislative Law

海南自贸港法规是《海南自由贸易港法》为海南自贸港特别创设的地方立法形态,它在制定主体、立法事项和生效方式等多方面异于普通地方性法规和经济特区法规等。变通性作为海南自贸港法规的基本属性,承载着海南自贸港法规制度的核心内涵。海南自贸港法规的变通性在对象、界限和程序上不同于经济特区法规和民族自治地方的自治法规。海南自贸港法规在对自贸港法治体系发挥支撑功能的同时,还应协调好改革试验与法治的关系,促进我国地方立法变通机制的完善。自贸港法规作为一项立法制度安排仍存在一定的发展和完善余地,未来需要有效参照和借鉴《立法法》第13条的相关机制。

Hainan Free Trade Port Regulations,as the local legislations made for Hainan Free Trade Port based on Hainan Free Trade Port Law,are different from other local regulations and Special Economic Zone Regulations in many ways like the subject who formulate it,the legislative items and the way of coming into effect.The legislative adaption is the fundamental feature of Hainan Free Trade Port Regulations and also the core element of it.The adaption of Hainan Free Trade Port Regulations is different from that of Special Economic Zone Regulations and Autonomous Regulations of ethnic autonomous areas in objective,boundary and procedure.Apart from functioning as a supportive tool,Hainan Free Trade Port Regulations should regulate the relation between reform experimentation and rule of law and make national local legislative mechanism better.There is room for Free Trade Port Regulations developing,article 13 of the Legislative Law should be as a reference in the future.
