死后人工生殖的伦理思考

人类辅助生殖技术将死后人工生殖由不可能变为技术可行,面对社会已经出现的死后人工生殖临床案例及逐渐增多的诉求,其影响对社会风俗、现行法律制度等意义重大。针对拟行死后人工生殖的成人,其可能因为受传统血脉传承文化的影响,或为行使成人的生育权利,或延续对死者的情感寄托等,但都会造成亲子关系混乱及子代权利受损,加之死后人工生殖亦是与人类辅助生殖技术的治疗疾病初衷相悖。所以,目前阶段大众应理性回归人类辅助生殖技术的应用初衷与本质,禁止死后人工生殖的开展。

Assisted reproductive technology has brought postmortem artificial reproduction to technologically feasible.With reported clinical cases and increasing demands of postmortem artificial reproduction,its impact is of great significance to social customs and current legal system.Reasons for adults planning to perform postmortem artificial reproduction may due to the influence of traditional bloodline culture,or to exercise adult reproductive rights,or to extend emotional sustenance to the deceased.But it will cause confusion in parent-child relationship and damage to the rights of offspring.In addition,postmortem artificial reproduction is also contrary to the original intention of assisted reproductive technology.Therefore,at present,the public should rationally return to the original intention and essence of the application of assisted reproductive technology,and prohibit performing postmortem artificial reproduction.
