总体国家安全观下的知识产权安全治理体系研究

A Study on the Security Management System of Intellectual Property under Overall National Security Concept

知识产权关系国家安全。既有研究着眼于具体风险,缺少基于总体国家安全观的理论阐释,难以回应日益复杂的知识产权安全形势。维护知识产权安全要在总体国家安全观的指导下回答治理什么、谁来治理以及如何治理三个问题。本文从本体论层面总结了知识产权安全的内涵,指出了知识产权安全的特征,明确了知识产权安全在国家安全体系中的定位;进而回答了知识产权安全治理对象、治理主体与治理路径的问题,并在此基础上构建了以国家知识产权安全战略为指导,知识产权安全法律制度与政策为主要手段,协同产业预警与应急机制和企业合规体系的现代化治理体系。本研究在理论上发展深化了总体国家安全观在知识产权领域的具体意涵,在实践上可为我国知识产权安全治理路径选择提供参考。

Intellectual property is a matter of national security.Existing studies focus on specific risks rather than theoretical explanation based on the overall national security concept,it is therefore difficult to deal with the increasingly complicated situations of intellectual property security.To safeguard intellectual property security,there are three questions to be answered under the guidance of the overall national security concept,i.e.,what to be governed,who to govern and how to govern.This paper summarizes the connotation of the security of intellectual property at the ontological level,points out the characteristics of the security of intellectual property,and makes clear the position of the security of intellectual property in the national security system.Then it answers the questions of governance object,governance subject and governance path.On this basis,this paper constructs a public-private collaborative governance system which takes the national intellectual property security strategy as the guidance,the intellectual property security legal system and policy as the main means,and the industrial early warning and emergency response mechanism and the enterprise compliance system as the coordination.In theory,this study deepens the specific meaning of the overall national security concept in the field of intellectual property,and in practice,it can provide reference for the choice of the governance path of intellectual property security in China.
