《贸易便利化协定》下我国跨境电商的发展道路

China's Cross Border E-commerce Development Path under the Agreement on Trade Facilitation

跨境电子商务近年来在我国的发展方兴未艾,但也呈现出诸多问题和困难,如何探索出一条更为有效的发展路径成为我国跨境电商领域面临的共同问题。本文首先分析了世贸组织《贸易便利化协定》中有关跨境电商规则制度的内容及现存缺陷,在此基础上通过中、日、韩三国跨境电商发展情况的对比,进一步指出了我国在该领域存在的不足,最后从规则和实践层面对如何利用世贸组织有关规则推进跨境电商发展提出了建议。

In recent years,the development of cross-border e-commerce in China has been in the ascendant,but there are also many problems and difficulties.How to explore a more effective development path has become a common problem in the field of cross-border e-commerce in China.This article first analyzes the contents and existing defects of the rules of cross-border e-commerce in the WTO Agreement on Trade Facilitation.On this basis,through the comparison of the development of cross-border e-commerce in China,Japan and South Korea,this article further points out the shortcomings of China in this field.Finally,it puts forward some suggestions on how to utilize the relevant rules of WTO to promote the development of cross-border e-commerce in China.
