教育惩戒权的立法现状与未来展望——兼评《中小学教育惩戒规则(试行)》 被引量:4

摘要 教育惩戒是教师合法行使教育管理权的重要手段,近年来对于中小学教师是否享有教育惩戒权也有许多争论。围绕《中小学教育惩戒规则(试行)》中的关键问题,对我国教育惩戒权的立法现状开展分析研究,指出《规则》的积极意义以及仍需解决的问题,提出进一步强化惩戒立法研究、细化教育惩戒规则以及提升教师法治素养的建议。 Educational discipline is an important measure for teachers to legally exercise the right of educational management.In recent years,there are many disputes about whether primary and secondary school teachers have the right of educational discipline.Focusing on the key issues in the Rules of disciplinary for primary and secondary school education(Trial),this paper analyzes the current situation of the legislation of the right of disciplinary for education in China,points out the positive significance of the Rules and problems to be solved,and puts forward some suggestions on further strengthening the research on the legislation of disciplinary,refining the rules and improving the legal literacy of teachers.
