论台湾居民在大陆社会权利的保障及其完善

On the Protection and Perfection of the Social Rights of Taiwan Residents in the Mainland

台湾居民在大陆社会权利的享有是落实同等待遇的关键指标,对深化两岸融合发展具有积极意义。长期以来,随着大陆涉台政策法律体系的与时俱进,台湾居民的社会权利问题越来越受到重视。检视大陆现有政策法律对台湾居民社会权利保障的现状可知,近年来,台湾居民在大陆的劳动权、受教育权和社会保障权都得到了很大发展,但社会权利的保障方式和内容仍有完善空间。健全台湾居民的社会权利,需要在制定政策时明晰政策内容,强化行政责任,廓清政策体系;在完善立法时进一步厘清台湾居民的法律身份,构建社会权利的权利束,赋予台湾居民程序性权利。在这一过程中,应鼓励地方涉台立法先行探索。

The enjoyment of social rights by Taiwan residents in the mainland is the key indicator for the implementation of equal treatment,which is of positive significance to deepening the development of cross-Strait integration.For a long time,with the development of the mainland's Taiwan-related policy and legal system,more and more attention has been paid to the issue of Taiwan residents'social rights.From the current situation of the mainland's policy and law on the social rights protection of Taiwan residents,we can see that the rights of labor,education and social security of Taiwan residents have been greatly developed in the recent years,but there is still room for improvement in the way and content of the protection.Therefore,to improve the social rights of Taiwan residents,it is necessary that the policy content be clarified,the administrative responsibility be strengthened and the policy system be cleared up when formulating policies.While in perfecting legislation,it is also imperative that we should further clarify the legal status of Taiwan residents,construct the bundle of social rights,and ensure Taiwan residents with procedural rights.Meanwhile,in this process,local Taiwan-related legislation should be encouraged to explore first.
