摘要
有关"思想/表达二分法"的理论争议与实践藩篱源自学界未能将其作为一项法律概念加以分析。从法律概念的价值取向与涵摄目的入手,可以发现著作权法对公共领域的价值偏好界定了"思想/表达二分法"的内涵;著作权法的司法实践划定了"思想/表达二分法"的外延。在价值取向支配与典型对象框定下,"思想/表达二分法"为涵摄非典型对象提供了价值依托与类比依据。
The theoretical controversy and practical barriers related to the"dichotomy of idea/expression"originate from the fact that scholars fail to analyze it as a legal concept.From the perspective of the value orientation and the subsumtion purpose of legal concepts,it can be revealed that the preference for public domain of the copyright law defines the connotation of the"dichotomy of idea/expression"while the judicial practice of the copyright law delimits the denotation of it.Under the domination of value orientation and the framework of typical objects,the"dichotomy idea/expression"provides the value support and analogy basis for the inclusion of atypical objects.
