Dynamic and Static Interaction between Criminal Policy and Social policy

定义刑事政策与定义社会政策都非常困难,可以在相对界定两者的范畴后论证两者的互动关系,并以个案为例,从动态上的相互弥补与静态上的相互渗透两个层面,说明社会政策对刑事政策的根本性影响及刑事政策对社会政策的反馈消化。如果说因为社会政策的制定与适用不足或不当,从而在某种情况下发生了某些犯罪,那么,刑事政策应当解决已然犯罪,同时可促成人们对社会政策的反思,以期制定更加科学与人道的社会政策。

For the difficulty in defining criminal policy and social policy,it is advisable to demonstrate the interaction between both of them after relatively defining the categories of criminal policy and social policy,and illustrate the fundamental influence of social policy on criminal policy as well as the feedback of criminal policy on social policy from two aspects of dynamic complementarity and static mutual penetration by taking a case as an example.If the formulation and application of social policies are inadequate or improper and some crimes occur in certain circumstances,criminal policies can be used to solve crimes already,and at the same time promote people to reflect on social policies,so as to formulate more scientific and humane social policies.
