On the Regulation of Digital Services from the Perspective of the European Union's Proposal for the Digital Service Act

欧盟《数字服务法(草案)》是全球数字服务保护最重要的提案之一,旨在为所有数字服务制定一套全面的新规则。《电子商务指令》存在若干方面的不足之处亟须改进,因而有必要在欧洲层面定义一套适当的规则。该草案旨在设置一个强有力和持久的治理结构来有效监督中介服务提供者,明确中介服务提供商的责任和问责制,为用户提供一个更安全、更透明的网络环境,值得我国镜鉴。

European Union's Proposal for the Digital Service Act is one of the most important proposals for the protection of global digital services,aiming to establish a comprehensive set of new rules for all digital services.There are some deficien⁃cies in the Electronic Commerce Directive that need to be improved.Therefore,it is necessary to define a set of appropriate rules at the European level.The draft aims to set up a strong and lasting governance structure to effectively supervise inter⁃mediary service providers,clarify the responsibilities and accountability of intermediary service providers,and provide users with a more secure and transparent network environment,which is worthy of our reference.
