《矿业、农业和建筑设备议定书》视域下我国融资租赁规范体系的完善

Enhancement of Chinese Financial Leasing Legal System from the Perspective of MAC Protocol

2019年11月通过的《矿业、农业和建筑设备议定书》延续了《开普敦公约》促进动产融资担保方面的重要功能,特别为矿业、农业和建设领域的交易开放提供了创新的工具,也为融资租赁业务在我国的扩张发展提供了良好的契机,进一步配合了我国《民法典》等相应规范的实施。未来,应借鉴公约规范,探索符合我国现状的融资租赁规范体系、加快建立独立统一的融资租赁法律规范、促进融资租赁业务法律实践的平稳运作、同步打造融资租赁交易实体规范和冲突规范,推进我国融资租赁业务的长期有序发展。

The MAC Protocol adopted in Nov.2019 continues the important function of the Cape Town Convention in promoting moveable property financing guarantees,provides innovative tools for the opening up of transactions in mining,agriculture and construction in particular,as well as a good opportunity for the expansion and development of finance lease business,and further cooperates with the implementation of Civil Code in China.In the future,implicated by the Convention,it is expected to explore a financial leasing regulatory system in line with status quo,accelerate the establishment of independent and unified financial leasing legal norms,enhance the smooth operation of legal practice of financial leasing business,improve both substantive laws as well as conflict laws regarding financing leasing,and promote the long-term orderly development of China’s financial leasing business.
