《反外国制裁法》:出台背景、内容构成及时代价值

The Law Against Foreign Sanctions of the People's Republic of China:Backgrounds,Contents and Values

鉴于西方某些国家及组织违背国际法基本原则,粗暴干涉中国内政,频频发起对中国及其相关实体企业与个人的所谓制裁,中国制定了《反外国制裁法》,从国家立法的高度,对外国的无理制裁进行更加有力的反制,以捍卫国家尊严和核心利益。该法的内容主要有立法目的与坚持的政策及原则、反制措施适用的情形和对象、具体反制措施、有关组织和个人履行《反外国制裁法》的义务、与反制措施相关的其他方面等。其时代价值体现在:有利于维护中国国家及相关组织和个人利益,有利于进一步树立中国负责任大国的形象,彰显中国利用国际法维护国家及本国组织、公民正当权益的态度和能力,有利于声张国际正义及为广大发展中国家维护自己的正当合法权益提供借鉴。

Under the background that some western countries and organizations have violated the basic principles of international law,grossly interfered in China's internal affairs,and frequently initiated the so-called sanctions against China and the related entities and the individuals in China,the Standing Committee of the National People’s Congress formulated the Law Against Foreign Sanctions of the People's Republic of China,which has provided us more effective anti-sanction measures to fight against foreign unreasonable sanctions from the perspective of national legislation with the aim of safeguarding national dignity and core interests.The contents of the law mainly include the legislative purpose and the policies and principles,the situations and objects of the application of anti-sanction measures,specific anti-sanction measures,the obligations of relevant organizations and individuals to implement the law against foreign sanctions,and other issues related to antisanction measures.Its values of the times are demonstrated as the following:it will be conducive to maintaining the interests of China's state,relevant organizations and individuals,further establishing the image of China as a responsible power,highlighting China's attitude and ability to use international law to uphold the legitimate rights and interests of the state,its organizations and citizens,advocating international justice and providing reference for developing countries to maintain their legitimate rights and interests.
