党内法规实施评估:内涵、现状、问题与完善理路——基于地方实践的观察与分析

Evaluation of the Implementation of Intra-Party Regulations:Connotation,Current Situation,Problems and Improvement--Based on the Observation and Analysis of Local Practice

党内法规实施评估是与党内法规制度建设、依规治党的理论和实践相关联的重要问题,应该具有规范性、科学性、实效性、可适用性等基本特征。从地方实践观察和分析,目前党内法规实施评估中存在缺乏规划和计划、评估主体的确定不规范、评估对象的选择较为随意、评估责任制度缺失、评估程序机制不完善等问题。贯彻落实习近平法治思想,深入推进依规治党,应当立足党内法规实施评估自身特点,尊重党内法规实施客观规律,坚持评估目的导向,对党内法规实施评估加以规范。借鉴相对成熟的立法评估理论,应当加强理论研究,探索制定党内法规实施评估办法,明确评估的启动、组织、责任、程序以及评估报告效力等基本问题,推动党内法规实施评估科学化规范化制度化。

The evaluation of the implementation of intra-Party regulations is a crucial issue related to the theory and practice of governing the Party by rules.It should have the basic characteristics of standardization,scientific nature,effectiveness and applicability.Based on the observation and analysis of local practice,there are still some problems in the current evaluation of intra-Party regulations,such as lack of planning,unclear evaluation subject,random selection of evaluation object,lack of evaluation responsibility system,and non-standard evaluation process mechanism.To implement Xi Jinping's thought on the rule of law and further promote Party governance according to rules,we should base itself on the characteristics,adhere to the objective orientated evaluation,respect the objective laws of the implementation,and standardize the system of evaluation.By learning from the relatively mature legislative evaluation system,we can strengthen theoretical research and explore the methods for the implementation of intra-Party regulations.We should clarify the basic issues such as the initiation,organization,responsibility,procedure,and effectiveness of the evaluation report.Therefore,the evaluation of the implementation of intra-Party regulations will be more scientific,institutionalized and standardized.
