三位一体:“法治中国”建设的战略转向

Trinity:the strategic shift in the construction of "the rule of law in China"

“法治中国”的战略部署及“法治国家、法治政府、法治社会”三位一体建设的具体路径,使我国法治建设进入一个更深入、更纯粹、更有目标指向的新的历史时期。“法治中国”作为宏观的战略纲领,具有法治意识形态的属性与特征;法治国家有具体指涉,它要求国家具有来自合宪、宪法至上的合法性,来自社会认同与人权保障的正当性,同时合乎理性和自然性;法治政府要求国家权力的赋予和实施必须制度化、规范化、程序化;法治社会则指社会的民主化、自治化、法治化,包括公民自律、市场自治及着力打造共同体。“三位一体建设”的路径选择具有客观必然性,是中国现实需要与域外法治理念借鉴的结果,也得到了当下的实践验证。这一选择具有中国属性与时代意义。

Strategy deployment of“Rule of Law in China”and specific path of three-in-one construction with“nomocracy country,nomocracy government and nomocracy society”,make our nomocracy construction get into deeper,purer and more target-oriented new historical period.“Rule of Law in China”,as a macroscopic strategy program,has attribute and feature of nomocracy ideology.Nomocracy country has specific signified.It requires that country has legality from constitutionality and constitutional supremacy,and justification from social identification and human right protection,meanwhile conforms to reason and naturalness.Nomocracy government requires endowment and execution of legislation,administration and jurisdiction must be institutionalized,be normalized and be programmed.Nomocracy society refers to democratization,autonomization and legalization of society,including citizens’self-discipline,market’s autonomy and focusing on developing communities.Path choice of“three-in-one construction”has objective inevitability.It is the result of Chinese reality needs and extraterritorial nomocracy ideas reference,and also gets present practical verification.This choice has Chinese attribute and contemporary meaning.
