摘要
行政约谈作为行政法治的新手段,具有非强制性和强调对行政过程的关注的特点,契合了行政法上的服务行政理论、行政过程论和平衡理论,在行政执法管理中具有不可替代的优越性。但由于目前对行政约谈的性质界定不清,以及行政约谈立法的不健全,致使行政约谈在现实运行中背离其初衷。因此,需要明确行政约谈的法律性质,完善行政约谈的法律依据,保障行政约谈的运行合法合规。
As a new means of rule of administrative law,because of its non-mandatory and emphasis on administrative process,administrative interview fits the service administration theory,administrative process theory and balance theory in administrative law,and so it has irreplaceable advantages in administrative management.However,due to the unclear definition of nature and the imperfect legislation of administrative interview,its application deviates from its original purpose.Therefore,it is necessary to clarify the legal nature,improve the legal basis,and ensure the legal compliance of administrative interview.
