摘要
文章以中国裁判文书网的207篇裁判文书为研究对象,采用计量分析和内容分析的方法,在分析研究对象整体特征的基础上,选择具有代表性的裁判文书作为典型案例,梳理出了我国图书馆在司法案件中著作权侵权和生命健康权侵权的表现,并从图书馆、与图书馆合作的第三方和用户三个层面提出了侵权风险的规避策略。
207 judgements from China Judgements Online are studied with the methods of quantitative analysis and content analysis.On the basis of analyzing the overall characteristics of the research objects,the representative judgements are selected to be typical cases to sort out the public libraries’performance of copyright infringement and infringement upon the rights of life and health.Prevention strategies are proposed in aspects of the library,the third party cooperating with the library and users.
