[目的/意义]伴随着国家安全的观念和形势的变化,国家情报工作也面临着新的变革。研究国家情报工作外包的法律规制,有助于形成国家情报外包合作的法律基础,进而为构建相应制度体系明确方向。[方法/过程]以美国为例对国家情报外包合作的法律规制进行研究,首先从美国现有规制情况出发,结合其实践状况,对美国相关法律规制予以检视,最终对于中国相关制度建设有所启示。[结果/结论]美国关于国家情报外包合作的法律规制是有缺憾的,中国在构建相关制度时应当正视可能的风险,注重顶层设计,加强多元共治。

[Purpose/Significance]Accompanied by changes in attitudes and circumstances of national security,national intelligence work is also facing new changes.Studying the legal regulations of national intelligence outsourcing will help form a legal basis for national intelligence outsourcing system,and clarify the direction for the construction of the appropriate institutional system.[Method/Process]Take the US as an example to study the legal regulations of outsourcing in the field of national intelligence.First,starting from the existing legal regulations in the US,combining its practical effects,reviewing the relevant legal regulations of the US,and finally giving some enlightenment to the construction of related systems in China.[Result/Conclusion]The legal regulations on outsourcing in national intelligence of the US are flawed.When constructing relevant systems,China should face up to possible risks,pay attention to top-level system design,and strengthen multiple co-governance.
