新闻版权是当代法治社会所关注的问题。随着网络科技的迅速革新、大数据技术的广泛融合以及人机交互技术的飞速发展,人工智能新闻作品的版权争论,成了业界关注的焦点。本文借助英美、大陆和中国特色社会主义法系总结出传统版权的法理基础,在分析人工智能新闻作品的类型、独创性的基础上明确了人工智能新闻作品的界定,并点出人工智能新闻作品与传统版权保护机制的冲突,得出人工智能新闻作品的版权应属于使用者的结论。

News copyright is a concern of contemporary society under the rule of law.With the rapid innovation of network technology,the extensive integration of big data technology,and the rapid development of human-computer interaction technology,the copyright dispute of artificial intelligence news works has become the focus of attention in the industry.This article summarizes the legal basis of traditional copyright with the help of the Anglo-American,mainland and socialist legal systems with Chinese characteristics.It clarifies the definition of artificial intelligence news works based on the analysis of the type and originality of artificial intelligence news works,and points out the the conflict between artificial intelligence news works and traditional copyright protection mechanism.It is con-cluded that the copyright of artificial intelligence news works should belong to the users.
