浅谈区别技术特征的认定与公知常识正确使用

A research about the Relationship between the Accuracy Recognition of Distinguishing Feature and the Correct Usage of Common General Knowledge

为客观公正的评判发明专利的创造性,应该准确认定申请事实,基于客观证据得出正确的结论。在创造性“三步法”运用中,应基于申请文件的记载,准确全面理解发明,确定发明解决的技术问题,采取的关键技术手段为某些技术特征的组合,当与最接近的现有技术比较时,功能上彼此支持、存在相互作用关系的技术特征都应将其作为一个整体考虑。对于区别技术特征,应当将其放在要求保护的技术方案整体中客观判断能够起到的作用,将其作为重新确定要解决的技术问题。认定公知常识应从为解决某个技术问题而采取某种技术手段的角度来考虑。本文选择两个案例,从正反两个方面探讨区别技术特征的认定和公知常识正确使用。

For judging the creativity of patent application justly and objectively,the factor of application should be recognized accuracy,the conclusion should be correctly based on objective evidence.Among the usage of"three step"judgment method of creativity,we should understand the application accuracy upon the application document and find the problem to be solved and the key technical means used.When the key technical means is the combina⁃tion of some technical feature or supported with each other on the function or interaction with each other compared with the closest prior art,the key technical means should be considered as a whole.For distinguishing feature,the ac⁃tual effect in the technical proposal should reconsidered based on the technical proposal as a whole.The confirming of common general knowledge should considered based on the technical problem and the technical means adopted.This paper,the accuracy recognition of Distinguishing technical feature and the correct usage of common general knowledge have discussed with two casings.
