企业涉疫情犯罪的合作治理:范式变迁、法理逻辑与实践进路

On Cooperative Governance of the Pandemic-Related Crime by Enterprises--Development,Legal Logic and Practice Approach

作为疫情期间主要的犯罪类型之一,企业犯罪的有效治理需要以合作范式为主导。人类社会结构已经从单中心过渡为多元主义,在此背景下,涉疫情企业犯罪的成因可以用社会失范理论加以揭示,纾困这种失范现象则有赖于从机械团结到有机团结的治理模式转换。就合作治理的具体建构而言,刑事政策应和其他社会政策分位阶、分阶段地作用于涉疫情企业犯罪的治理。作为公共部门的政府和司法机关,亦应从外部和内部两个维度,联合民营企业共同优化营商环境。司法机关主导同被追诉企业积极开展合作型司法,拓展认罪认罚从宽的实践适用空间。

Corporate crime is a major form during the pandemic and cooperative governance is an effective way to deal with it.The structure of human society has changed fromsingle center to pluralism.In this context,the pandemic-related corporate crimes can be explained by the theory of social anomie.To solve this problem,the governance should be transformed from mechanical unity to organic unity.As to the measures of cooperative governance,criminal principle should be applied with other social policies to handle the crimesindifferent circumstances.Being public sectors,the government and judicial department should create a better business environment from both external and internal aspects,together with private enterprises.The judicial department should also cooperate with the accused to expand the practice of leniency for confession and punishment.
