专利证券化中基础资产认定及风险防范研究

Research on the Identification of Basic Assets and Risk Prevention in Patent Securitization

基于资产证券化的一般原理,结合国外专利证券化的实践,对专利证券化的基础资产展开论述。无论是在理论层面还是实践层面,专利资产证券化的难点之一都是基础资产的界定。因此,主要从基础资产的国外立法出发,探讨专利证券化中基础资产的认定标准以及基础资产的种类,最后从法律风险和经济风险两个方面对基础资产风险防范措施进行了总结。

Based on the general principles of asset securitization,combined with the practice of foreign patent securitization,this paper discusses the basic assets of patent securitization.In practice,one of the difficulties of patent asset securitization is the definition of basic assets.This paper mainly discusses the identification standards and types of basic assets from the perspective of foreign legislation and the evolution of China’s legislation.Finally,it summarizes the preventive measures from two aspects of legal risk and economic risk.
