数字时代文化遗产机构资源保存版权例外规则:困境与解决

由于数字技术的快速发展,我国文化遗产机构资源保存版权例外的法律法规和相关制度出现了适用上的困境,有必要予以完善。许多国家已经明确地将文化遗产机构的保存行为纳入其版权例外的范畴,并应数字时代的要求而对受益主体和使用对象、使用的目的和方式、合同条款和技术措施等方面进行了修改,值得借鉴。为了使我国文化遗产机构的资源保存活动能够顺利进行,应扩大目前著作权法中文化遗产保存例外各要件的范围,并完善文化遗产机构保存例外的其他相关制度。

Due to the rapid development of digital technology the application of laws regulations and related systems in the copyright exception of resource preservation in cultural heritage institutions in China is in a di-lemma so it is necessary to improve them.Many countries have explicitly included the preservation of cultural heritage institutions into the scope of their copyright exceptions.In response to the requirements of the digital age they have revised the beneficiary users purposes methods contract clauses and technical measures which are worth learning.In order to realize the preservation of works by cultural heritage institutions smoothly we should expand the scope of the elements of cultural heritage preservation exceptions in the current copyright law and improve other relevant systems of cultural heritage institution preservation exception.
