行政法法典化的路径研究

作为我国三大部门法之一的行政法,其法典化的呼声日益强烈。在新时代全面深化改革,着力于推进国家治理体系和治理能力现代化的进程中需要积极的发挥行政的功能,面对进一步深入推进依法行政,加快建设法治政府,行政立法传统的碎片模式亟需转向体系化建设。当前推进行政立法法典化,具备了一定的理论研究基础与立法经验积累,行政立法法典化在我国不仅必要,而且可行。

As one of the three branches of law in our country,administrative law is becoming more and more codification.In the new era,we need to deepen reform in an all-round way and give full play to administrative functions in the process of modernizing the country’s governance system and governance capacity.In the face of further deepening administration according to law and accelerating the building of a government ruled by law,the traditional fragmented model of administrative legislation needs to be systematized.At present,the codification of administrative legislation is not only necessary but also feasible in our country,which has certain theoretical research basis and legislative experience.
