涉军法律援助制度是中国特色法律援助事业的重要组成部分,是实现军人军属维权诉求的法治运行有效机制。军地协作开展法律援助是构建完整法律援助制度的关键一环,具有独立的司法价值和卓殊的社会价值。随着军民融合战略持续深度发展,强化军地协作可在军地统筹模式下实现资源共享,军地互带互动有助于克服涉军法律援助“名实不符”的形式化弊端,破除军队“单兵作战”的片面化倾向,解决基层部队法律援助服务“供需失衡”的消极化难题。

The military-related legal aid system is an important part of the legal aid with Chinese characteristics,and it is an effective mechanism of legal operation to realize the demands of safeguarding the rights of soldiers and their families.The military-civilian cooperation in the development of legal aid is a key part of the establishment of a complete legal aid system,which has independent judicial value and outstanding social value.With the continuous and in-depth development of the military-civilian integration strategy,strengthening military-civilian coordination can achieve resource sharing under the military-civilian coordination mode.The mutual interaction between military and local governments can help overcome the formal malpractice of military-related legal aid“inconsistent in name and reality”and break the army“normal”one-sided tendency,solve the negative problem of the“imbalance between supply and demand”of legal aid services for grassroots troops.
