摘要
为维护新冠疫情下劳动关系的稳定,行政文件创制了大量的劳动权利义务规范,但因劳动应急法律制度存在空白、行政机关忽视立法论证及外部回应动力不足等,这些文件在合法性、合理性和执行力方面都存在诸多的问题。鉴此,对之应充分发挥立法与司法机关对行政规范性文件的监督与审查责任;在“最大保护”原则的指导下,通过法律将应急时期劳动者工资福利待遇、劳动合同解除与工时休假、应急劳动社会保障制度等内容予以明确规制,并从内部程序规范体系和外部程序规范体系两方面建立应急权授予制度,完善权力行使之规范。
In order to maintain the stability of labor relations in COVID-19,a large number of labor rights and obligations have been created in administrative documents.Due to the blankness of the labor emergency legal sys⁃tem,the neglect of the legislative arguments of the administrative agencies and the lack of external response condi⁃tions,these documents have problems in terms of legitimacy,rationality and enforcement.In view of this,the legis⁃lative and judicial organs should give full play to the supervision and review of administrative normative documents.Under the guidance of the"maximum protection"principle,workers’salary and welfare in emergency period,termi⁃nation of labor contract,organization of word and leave time,and emergency labor social security system should be clearly regulated by laws,and the emergency authority should be established to perfect the authority exercising norms from the internal procedure standard system and the external procedure standard system.
