政府数据开放平台用户协议合规性评估

Assessment of User Agreement Compliance for Open Government Data Platforms

对政府数据开放平台用户协议进行研究,有助于保障政府数据开放平台用户的正当权益,并促进政府数据开放平台的健康发展。文章运用统计分析法与比较分析法,依据所设计的观测指标,对我国30个地方政府数据开放平台用户协议进行合规性审查,并提出其合规路径。研究发现,我国政府数据开放平台用户协议存在开放数据授权不明确、敏感数据开放利用规则缺失、平台安全保障措施不到位、平台未履行公开信息收集与处理的义务、未切实披露用户的信息权利、不当免除自身责任、意见反馈渠道单一、服务变更、中止或终止的原因不明晰、协议更新的通知方式不合理等问题。为此,我国应建立用户协议强制性标准,明确用户和平台的权利义务关系,提高用户信息安全保障能力,制定不同类型数据开放获取规则并建立合理的协议同意机制。

The research on user agreement of open government data platforms could help to protect the legitimate rights and interests of open government data platform users,and to promote the healthy development of open government data platforms.A set of observation indexes are designed,then a statistical and comparative analysis is made of the user agreements of 30 local open government data platforms in China,and in the end some compliance paths are proposed.The result shows that there are some severe problems in the user agreements of those open government data platforms in China,such as the unclearness in open data authorization,the absence of rules for sensitive data application,the insufficiency of data security measures,the failure to fulfill their duty of open data collecting and processing,the ineffective disclosure of users’rights,the improper self-exemption,the narrowness of feedback channels,the vagueness in their declaration of service change or termination,the irrationality of protocol update notification methods,and so on.Therefore,it is proposed to establish mandatory user agreement standards,clarify the rights and obligations of both users and the platforms,improve users’information security capabilities,formulate open access rules for different types of data,and establish a reasonable agreement mechanism.
