摘要
传统消费纠纷解决机制难以处理在线消费纠纷的根本原因是在线消费纠纷标的额小额性与维权成本高额性之间存在矛盾,ODR机制可以突破时空限制、提高纠纷解决效率,解决在线消费纠纷标的额小额性与维权成本高额性的矛盾,因此成为许多国家纠纷解决机制创新的重点发展对象。本文以消费者保护为视角,在研究东盟电子商务ODR机制的基础上,找寻东盟电子商务ODR机制对我国ODR机制建设的可借鉴之处。
There is a contradiction between the small amount of online consumer disputes and the high cost of rights protection,which is the fundamental reason why the traditional consumer dispute resolution mechanism is difficult to handle online consumer disputes.Be cause the ODR mechanism can break through the limitation of time and space,improve the efficiency of dispute resolution,and solve the aforementioned conflicts,it has become an important project for many countries to innovate the dispute resolution mechanism.From the per spective of consumer protection,this paper,based on the study of ASEAN e-commerce ODR mechanism,looks for the reference for the construction of China’s ODR mechanism.
