论网络社会视阈下法的价值

The value of law from the perspective of network society

法的价值具有社会性,这是因为法本身、人,以及人的需求具有社会性。因此,在研究法的价值时,不能脱离具体的社会背景。网络社会是由信息革命推动而出现的社会空间,网络社会既依附于传统现实社会,又悬置于传统现实社会之外,法的价值在网络社会中与在传统现实社会中也有着不同。秩序作为法的基础价值在网络社会中经历了“工具论”向“空间论”的转变。自由是人对法的永恒价值追求,必须用法明确网络社会中新的自由可能性转化为现实自由的边界。作为法终极价值的公正应在网络社会和传统现实社会中予以统筹,使其成为两种社会共同的终极价值目标。

The value of law embodies the characteristic of social because law itself,man,and man’s needs are social.Therefore,the study of the law value can not be divorced from the specific social context.The network society is a social space promoted by the information revolution.The network society is attached to and suspended from the traditional real society.The value of law in the network society is different from that in the traditional real society.Order,as the basic value of law,has undergone a transformation from“instrumental theory”to“spatial theory”in the network society.Freedom is man’s eternal pursuit of law.We must make clear the boundary of the new possibility of freedom in the network society.As the ultimate value of law,justice should be coordinated in the network society and the traditional reality society,so that it becomes the common ultimate value goal of the two societies.
