警务用枪行为评价问题探讨

警务用枪行为评价涉及评价主体、方式、程序、内容、标准、过程、结果等问题。目前,有关法律体系不健全,涉及警务用枪的法律用语模糊,涉及调查处理环节的法律规定不科学。应健全和完善警务用枪行为相关法律体系,加大警务用枪权利的司法救济力度,增强警务用枪评价可操作性,拓展警务用枪情形,确保警务用枪行为审查的独立性与专业性。

Behavior evaluation of police gun involves evaluation subject,method,procedure,content,standard,process,result and so on.At present,the relevant legal system is not sound,the legal term concerning police guns is vague,and the legal provisions concerning the investigation and processing are not scientific.It is necessary to improve and perfect the relevant legal system of police gun,strengthen the judicial relief of using guns for the police,enhance the operability of police gun behavior evaluation,expand the circumstances of using guns for the police,and ensure the independence and professionalism of police gun behavior review.
