我国《民法典》中绿色原则对企业绿色化发展的影响

A Brief Analysis of the Influence of the Green Principle in China's Civil Code on the Green Development of Enterprises

《中华人民共和国民法典》颁布后,中国进入了法典化时代,届时民法典将会给我国社会各个层面带来深刻的变化。作为《民法典》基本原则的绿色原则,通过“保护环境”“节约资源”这种不确定性法律概念,导致实践中该原则的准确适用与适用实效,尚未能在《民法典》分则中具体展开。本文将探讨《民法典》中的绿色原则对于我国企业发展带来的影响,着重讨论绿色原则对于商事主体的影响,包括对于企业主体资格的影响、合同效力的影响,以及在绿色原则下企业的法律责任问题,力图充分发挥绿色原则的作用,为推动生态环境建设贡献法律化思维。

After the promulgation of the Civil Code of the People's Republic of China,China has entered the codification era,which will bring profound changes to all levels of Chinese society.This article explores green principles of the Civil Code for the impact of enterprise development in our country,the influence of green principles for business subject is discussed in this paper,including the influence of the qualification for enterprise,the influence of the contract effectiveness,as well as the legal liability issues under the principles of green enterprises,tried to give full play to the role of the green principle,to promote the ecological environment construction contribution legalization of thinking.
