摘要
为适应医疗保障法治化的迫切需求,我国医疗保障领域立法工作开始提速。据全国人大常委会2021年度立法工作计划,医疗保障法已被列入预备审议项目。国家医疗保障局研究起草了《医疗保障法(征求意见稿)》并向社会公开征求意见。医疗保障法的制定,对于保障国民医疗保障权益,提升医疗保障的法治化水平,推动医疗保障工作高质量发展都具有非常重要的意义。为提升医疗保障法的立法质量和科学性,实现医疗保障领域的良法善治,本文从分析立法目的、界定制度体系、明确制度定位等角度,提出了进一步完善医疗保障法律规定的意见建议。
In order to meet the urgent needs of the legalization of healthcare security,China's legislation in the fi eld of healthcare security began to speed up.According to the legislative work plan of the Standing Committee of the National People's Congress for 2021,the Healthcare Security Law has been included in the preparatory review item.The National Healthcare Security Bureau has studied and drafted the Healthcare Security Law Draft and solicited opinions from the public.The formulation of the Healthcare Security Law is of great signifi cance to protect the rights and interests of national healthcare security,improve the legalization level of healthcare security,and promote the high-quality development of healthcare security.In order to improve the legislative quality and scientifi city of the Healthcare Security Law and realize good law and good governance in the fi eld of healthcare security,this paper puts forward opinions and suggestions on further improving the legal provisions of healthcare security from the perspective of analyzing the legislative purpose,defi ning the system and clarifying the system positioning.
