评标专家赔偿责任理论及其规范化研究

Research on the Theory of Bidding Evaluation Experts’Compensation Responsibility and the Standardization

新《招标投标法》的修订,试图确立招投标制度项下评标专家的赔偿责任,然而评标专家与招标者法律关系问题不甚明晰,赔偿对象更是没有明文规定。因此主要研究评标专家的法律属性、赔偿性质、赔偿对象,在雇佣关系的基础法律关系前提下评标专家承担的责任系专家责任,但对赔偿对象第三人的范围应加以限制。

The revision of the new“Tendering and Bidding Law”attempts to establish the liability for compensation of bid evaluation experts under the bidding system.However,the legal relationship between bid evaluation experts and bidders is confused,and there is no explicit stipulation on the compensation object.Therefore,this paper mainly studies the legal attributes,nature of compensation,and compensation objects of bid evaluation experts.Under the premise of the basic legal relationship of the employment relationship,the responsibility of bid evaluation experts is the responsibility of experts,but the scope of compensation for third parties should be limited.
