摘要
著作权法是随着经济社会发展和技术进步而与时俱进的文化创新促进法,著作权制度的建立和发展以著作权法的颁行为依托。我国《著作权法》自1991年实施以来,经过多次修订,实质性地提高了著作权保护水平。2020年修改的《著作权法》对著作权制度的多个方面进行优化,对在新发展格局阶段促进我国文化科学事业繁荣发展具有十分重要的意义和作用。现行《著作权法》中的诸多内容需要在司法实践中予以落实。基于著作权立法体系及其调整社会关系的复杂性,著作权司法实践中应充分考虑未明确规定在现行《著作权法》中的一些重要原则,相关制度也有待进一步改进。
The copyright law is a cultural innovation promotion law that keeps pace with the economic and social development and technological progress.The establishment and development of copyright system is based on the promulgation of copyright law.Since its implementation in 1991,China′s Copyright Law has been revised many times,which has substantially improved the level of copyright protection.The Copyright Law revised in 2020 optimizes many aspects of the copyright system,which is of great significance in promoting the prosperity and development of China′s cultural and scientific undertakings in the new development pattern stage.Many contents of the current Copyright Law need to be implemented in judicial practice.Based on the complexity of the copyright legislation system and its adjustment of social relations,we should fully consider some important principles that are not clearly stipulated in the current"Copyright Law"in the judicial practice of copyright,and the relevant systems need to be further improved.
