国家治理现代化背景下《外商投资法》的颁行及影响

Enactment and Impact of Foreign Investment Law under the Background of Modernization of National Governance

当前,在我国积极推动实现国家治理现代化之际,《外商投资法》的颁布实施具有极其重要的意义。这部基础性法律对我国传统外商投资管理体制进行了根本性改革与重构,在征收补偿、知识产权保护、标准制定、政府采购、融资、监管等多方面条款规定中重点聚焦对外商投资的促进与保护措施。《外商投资法》的实施将在外商投资治理领域对我国的立法、行政、司法等国家各级机关产生深刻影响。国家各级立法、行政、司法机关亟须深入实施“废改立”,科学立法;全面运用法治思维,严格执法;转换协调法律适用,公正司法。

At present,as China actively promotes the realization of the vision and goal of national governance modernization,the enactment of Foreign Investment Law is of great significance.This fundamental law is the fundamental reform and reconstruction of the governance system of Chinese traditional foreign investment,and focuses on the promotion and protection steps of foreign investment with regard to collection compensation,intellectual property protection,standard setting,government procurement,financing,supervision and other provisions.The implementation of Foreign Investment Law will have a profound impact on the governance of state organs including legislation,administration and judicature at all levels in the field of foreign investment.The legislative,administrative and judicial organs at all levels need to implement the law system’s abolishing,amending or passing and make more scientific legislation,to fully use the thinking of rule of law and strictly enforce the law,and to transform and coordinate the application of law and justly implement judicature etc.
