On the Joint Offense of Aggregated Consequential Offense

结果加重犯的共同犯罪同时涉及结果加重犯、共同犯罪、过失犯罪等领域。在实际中,判断未直接引发加重结果的行为人是否要对加重结果承担刑事责任,具体分为两种情况:一是部分行为人故意引发加重结果,未直接引发加重结果者如果对加重结果的产生具有因果贡献力且存在过失,应当对其承担责任;二是全体行为人均有过失,如果其参与实施的基本行为与加重结果存在相当因果关系,且行为人对基本行为有明确认知,对加重结果有认识可能性,也宜就加重结果部分成立共同犯罪。同时,教唆者和故意帮助者在教唆、帮助的内容被实际执行,且行为本身对于加重结果的产生具有直接作用力的情形下,可以成立结果加重犯的狭义共犯。

The joint offense of aggregated consequential offense involves the fields of aggravated offense,joint offense,and criminal negligence.In actual judgment,should the perpetrator who did not directly cause the aggravated result bear criminal responsibility for the aggravated result?Specifically,there are two situations.The first is that some perpetrators deliberately cause the aggravated result,and those who did not directly trig‐ger the aggravated result should be held responsible if they have causally contributed to the aggravated result and are at fault;the second is that all perpetrators are at fault,and if the basic be‐havior involved in the implementation is causally related to the aggravated result and the perpetrators have a clear understand‐ing of the basic behavior and the possibility of the aggravated result,it is advisable to establish a joint offense on the aggra‐vated result.At the same time,the instigator and deliberate helper can be established as a narrowly defined accomplice of the aggravated result when the content of the instigation and help is actually executed,and the behavior itself has a direct effect on the aggravated result.
