在法治中国建设的背景下,执政党要处理好治党与治国的关系,就要从根本上回答党章与宪法的关系命题。习近平法治思想提出要坚持党的领导、人民当家作主、依法治国有机统一,要求和保证党章与宪法在本质上具有同一性,厘定了二者关系的政治命题。在该政治命题的统领下,党领导国家法治建设的历史事实决定了党章引领宪法变迁是二者关系的历史命题;党规和国法的体系建设围绕坚持建设中国特色社会主义法治体系而展开,形成二者相辅相成、相互促进、相互保障的格局,是党章和宪法关系的制度命题;在具体实践中,党既要领导人民制定宪法和法律,又要领导人民实施宪法和法律,党自身必须在宪法和法律范围内活动,坚持依法治国和依规治党有机统一因而成为党章与宪法关系的实践命题。政治命题、历史命题、制度命题和实践命题,四者共同揭示了党章与宪法的关系。

In the context of the construction of the rule of law in China,the CPC must fundamentally answer the proposition of the relationship between the Party Constitution and the Constitution to handle the relationship between the party and the country.Xi Jinping Thought on the Rule of Law proposes to preserve the organic unity of Party leadership,the running of the country by the people,and law-based governance,which defines the political proposition of the relationship between the two.Under the leadership of this political proposition,the Party Constitution leads the Constitutional amendment is the historical proposition of the relationship between the two;the construction of a socialist rule of law system with Chinese characteristics is the system proposition of the relationship between the two;adhering to the organic unity of the law-based governance of China and the regulations-based governance over the Party is the practical proposition of the relationship between the two.The political propositions,historical propositions,system propositions and practical propositions,together reveal the relationship between the Party Constitution and the Constitution.
