社会组织法治化管理的制度建构研究

System Construction of Legal Management of Social Organizations

党的十八大用"社会治理"代替了"社会管理",这一字之别却体现出国家在社会运行方面思路的转变,从以稳定为中心的社会管理转变为以秩序为中心的社会治理。对于社会组织的管理方式也逐步向法治化治理转变。新中国成立以来,我国社会组织法治化管理历经萌芽、探索、稳定、深化四个阶段。当前,社会组织在基础性法律体系、政府依法管理、"三社联动"等方面已取得了显著成就,也获取了的宝贵经验。但是还存在着党建工作有待于加强、社会组织的法治文化有待于养成、政府的综合协调能力有待于提高、社会组织管理的法律体系有待于完善等问题。对此,应加强党对社会组织的政治引领;增强法治引导,依法依规治理社会组织;发展新型政府与社会组织关系;完善相关制度,健全社会组织的管理机制。

The 18 th CPC National Congress replaces "social management" with "social governance", which reflects the transformation of China’s thinking in social operation from social management centering on stability to social governance centering on order. The management mode of social organizations is also gradually transforming to legal governance. Since the founding of New China, the legal management of social organizations in our country has gone through four stages, i.e., germination stage, exploration stage, stability stage and deepening stage. At present, social organizations have made remarkable achievements and gained valuable experience in basic legal system, government administration according to the law, and the "three community aspects’ linkage and interaction", but there still exist such problems that the Party construction needs to be strengthened, the legal culture of social organizations needs to be cultivated, government’s comprehensive coordination ability needs to be improved, and the legal system of social organization management needs to be perfected. In this regard, it is necessary to strengthen the Party’s political guidance to social organizations, enhance the legal guidance and govern social organizations in accordance with the law, develop the new relationship between government and social organizations, perfect the relevant system and improve the management mechanism of social organizations.
