境外电子数据的取得与运用——基于第67号检察指导性案例的展开

境外电子数据的取得与运用是有效打击跨境网络犯罪的关键环节。第67号检察指导性案例展现了境外电子数据与境内电子数据在证据取得、移送、保管、审查运用上的差异,明确了检察机关在境外电子数据运用上的基本立场,具有重要指导意义。这也是最高检察机关首次以指导性案例的方式对境外电子数据取得与运用问题作出回应,体现出刑事证据法从一元到二元(国内证据、境外证据)的分化发展,以及境外传统类型证据与境外电子数据在运用规则上的再次分化。

The acquisition and application of cross-border electronic data is the key step in effectively combating cross-border crimes in cyberspace. The Guiding Case No. 67 of The Supreme People’s Procuratorate demonstrates the differences between cross-border electronic data and domestic electronic data in acquisition,transfer,storage,and review of the data as evidence. It clarifies the basic principle of the procuratorial agency on the application of cross-border electronic data,which has important guiding significance. This is also the first time that The Supreme People’s Procuratorate has responded to the acquisition and application of cross-border electronic data in the form of guiding case,which reflects the differentiated developments of the criminal evidence law,which are,namely,the cross-boarder evidence norm deriving from the original domestic one,and the differentiation of the rules regarding to the application of the tradition evidence and electronic one within the norm of the cross-boarder evidence.
