摘要
在我国,大多数行政裁量基准以“其他行政规范性文件”的形式出现,这样的行政裁量基准其性质和效力如何?学界有诸多的争论。而不同的观点则直接影响着法院对涉及行政裁量基准案件的审查态度。在这些争论之中,承认行政裁量基准具有事实上的拘束力最能与其功能相适应。根据这一观点,如果某一裁量性行政行为是依行政裁量基准作出时,法院需要将行政裁量基准作为该行为的审查依据,但法院也需事先对裁量基准进行合法性、合理性的审查;而如果某一裁量性行政行为径直依法律法规作出时,法院则需要寻找是否存在事先制定好的行政裁量基准,当然,该基准仍需在审查过后才能作为法院判案的依据。
In China,most of the administrative discretion standards appear in the form of other administrative normative documents.While there are many controversies about the nature and effectiveness of such administrative discretion standards in academia.And,different viewpoints directly influence the court's attitude towards reviewing cases involving administrative discretion benchmarks.Among these controversies,admitting that the administrative discretion standard has actual binding force is best suited to its function.According to this point of view,if a discretionary administrative act is made on the basis of administrative discretion,the court needs to use the administrative discretion standard as the basis for review of the act,but the court also needs to review the legality and rationality of the discretion in advance;And if a discretionary administrative act is made directly in accordance with laws and regulations,the court needs to find out whether there is a pre-established administrative discretion standard.Of course,the standard still needs to be reviewed before it can be used as the basis for the court to decide the case.
